1. General Acceptance

These Terms of Service ("Agreement" or "Terms of Service") establish the legally binding terms and conditions regarding the use of services (hereinafter referred to as "Service(s)") provided by Generatech Studio, Inc. ("Generatech AI", "Generatech", "we" or "our company"). Generatech AI enables users to generate content using generative AI models in various categories, including not only visual content but also chat, video, audio, and 3D content production. By accessing or using our Services, you are deemed to have accepted these Terms of Service.

2. Scope of Services and Additional Terms

Services provided by Generatech AI include generative AI models in the following categories:

• Chat: ChatGPT, Claude, Gemini, and similar language models.
• Visual: DALL-E, Stable Diffusion, Flux, and other similar models.
• Video: Specialized models for video production and editing.
• Audio: Voice synthesis, text-to-speech, and music generation models.
• 3D: 3D modeling, rendering, and animation creation models.

Some Services may include additional terms and usage rules specific to the categories mentioned above. Such additional terms are considered to be incorporated into these Terms of Service, and your access to the Services will also be subject to these conditions.

3. Intellectual Property Rights and Trademarks

Trademarks and Patents: All logos, brand names, design elements, and other visual or auditory marks belonging to Generatech AI are subject to relevant legal protections. Unauthorized use of these marks is prohibited.

User-Generated Content: Copyright and other proprietary rights you have in the content ("Content(s)") you create through the Services are reserved, except for licensing as specified below.

4. License Terms and Rights Transfers

Permission to Use: In accordance with this Agreement and relevant additional terms, we grant you a non-exclusive, limited, non-transferable, non-sublicensable, and revocable at our discretion license to access and use Generatech AI Services.

Rights to Content: All Content you create through the Services belongs entirely to you. However, all Content created as a result of your use of the Services is deemed to be licensed to Generatech AI with a permanent, worldwide, free, sublicensable, irrevocable right for the purpose of providing, maintaining, promoting, improving the Service and fulfilling relevant legal obligations.

License Sharing with Other Users: Content that you publicly share in the Services is licensed to be accessible and usable by other users as well. This license can only be used within the framework of the Service's functions.

5. Digital Property Rights and DMCA Policy

Generatech AI acknowledges that Content generated by AI models may, in some cases, resemble materials protected by copyright or trademark. In case of any copyright or trademark infringement claim, please write to support@generatech.ai. Your claim will be evaluated, and if necessary, the relevant Content will be removed or edited.

6. Modification and Update of Services

Generatech AI reserves the right to modify, suspend, or terminate these Terms of Service or any feature, database, or content of the Services without prior notice. Updates will be announced via our website or the Services. Your continued use of the Services implies your acceptance of the updated Terms of Service.

7. Fees and Payment Terms

Free and Paid Services: Generatech AI offers free and subscription-based paid plans. Paid plans may include monthly or annual subscription options.

Billing and Renewal: Subscriptions are automatically renewed according to the selected payment period. Membership cancellation can be performed via the website or by writing to support@generatech.ai. In case of cancellation, previously invoiced amounts are non-refundable.

Taxes: All applicable taxes, fees, and similar financial obligations in addition to subscription fees are the responsibility of the user.

Account Management: Each user is given a unique account, and the user is responsible for all activities that occur under the account.

8. User Behavior Rules and Prohibited Activities

Users agree not to engage in the following activities while using the Services:

Illegal Activities: Producing or sharing content that violates any legal regulation, infringes copyrights, includes defamation, hate speech, threats, harassment, misleading or deceptive content.

Activities Harmful to Infrastructure: Activities aimed at content extraction through data scraping, reverse engineering, or similar methods that will place disproportionate load on the infrastructure of Generatech AI or third-party service providers.

Security Breaches: Gaining unauthorized access to the Service, hijacking accounts, spreading malicious software, or engaging in any intervention that would prevent the proper functioning of the Services.

Model-Specific Prohibitions: Content created using AI models (ChatGPT, Claude, Gemini, DALL-E, Stable Diffusion, Flux, etc.) that contains hate speech, violence, sexuality, child abuse, misleading information, or other harmful content is strictly prohibited.

Public Safety: Creation of any content that could threaten public order, terrorist propaganda, dissemination of fake news, or content of a misleading nature to masses is prohibited.

9. Account Closure and Service Termination

Generatech AI reserves the right to immediately suspend or terminate access to any user account due to violation of the Terms of Service, inappropriate behavior, or other reasons. Either party may terminate the Services for any reason through written notification. In case of termination of the Services, paid fees are non-refundable, and all user rights immediately cease.

10. Indemnity and Disclaimer

Indemnity: You agree to defend, indemnify, and hold harmless Generatech AI and its affiliates, directors, employees, and representatives from all damages, losses, claims, expenses, and legal costs (including reasonable attorney fees) that may arise from or in connection with the use of the Services.

Limitation of Liability: Generatech AI cannot be held responsible for indirect, incidental, special, punitive, or consequential damages. The total direct damage is subject to not exceeding an amount such as the subscription fee or the total amount paid, whichever is higher.

11. User-Generated Content and Licensing

11.1 General Terms

Users may upload, publish, or transmit content (text, visual, video, audio, 3D model, etc.) to the Services ("User Content"). You declare that you have legal rights to any content you upload or have the necessary permissions.

11.2 License to Generatech AI

Sharing your User Content through the Services grants Generatech AI a worldwide, non-exclusive, irrevocable, free, fully paid, and sublicensable right to use for hosting, storing, reproducing, distributing, public display, presentation, and creating derivative works when necessary, for the purpose of providing and improving the Services.

11.3 Access by Other Users

Publicly shared content becomes accessible and usable by other users within the scope of the features offered by the Service. Responsibility for this content lies entirely with the user who created it.

11.4 Content Review and Editing

Generatech AI reserves the right to edit, remove, or block content that is determined to violate the Terms of Service, without prior notice. In such a case, the user is deemed to have waived their rights over the content.

12. Content Monitoring and Supervision

Generatech AI reserves the right to monitor, record, and supervise content shared or created through the Services. This monitoring is done to ensure the operation of the Service, enhance security, fulfill legal obligations, and maintain content quality. Generatech AI cannot be held responsible in any way for content supervision.

13. Disclaimer of Warranties

Services are provided "as is" and "as available." Generatech AI does not guarantee that the Services will operate uninterrupted, error-free, or completely secure. All usage risks belong to the user, without any express or implied warranty for the provided content and generated results.

14. Age Restriction and Legal Capacity

By accessing the Services, you declare that you are at least 13 years old and meet the minimum age for digital consent determined by your country. Users under the age of 13 are not allowed to access the Services without the approval of a parent or legal guardian. Parents or legal guardians are held responsible for their children's use of the Services.

15. Miscellaneous Provisions

Entire Agreement: These Terms of Service invalidate all previous verbal, written, or electronic communications between you and Generatech AI regarding the Services.

Binding and Transfer: These terms are personally binding between you and Generatech AI's legal representatives. Neither party may transfer their rights or obligations without the written permission of the other.

Waiver: The failure of either party to exercise any right does not mean waiving that right.

Applicable Law and Jurisdiction: These Terms of Service are subject to relevant legal regulations. In the resolution of disputes, the jurisdiction where Generatech AI's headquarters is located will be applicable.

Notifications: All notifications will be made via email (support@generatech.ai), written letters, or electronic communication. For notifications to be considered valid, it is necessary to confirm they have reached the recipient.
